1. Agreement to Terms

By downloading, installing, accessing, or using Social Wand ("App", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including without limitation users who are browsers, customers, merchants, and contributors of content.

2. Description of Service

Social Wand is a mobile application that provides AI-powered assistance for social communication. Our Service includes, but is not limited to:

• Smart Replies: AI-generated reply suggestions for messages and conversations
• Conversation Starters: AI-generated opening lines and conversation openers based on photos
• Pickup Lines & Ice Breakers: AI-generated pickup lines and conversation starters for various topics and styles
• Dating Apps Assistant: Specialized features for dating apps including opening lines, profile optimization, conversation continuation, and date planning
• Awkward Situation Helper: AI-powered advice and response suggestions for challenging social situations
• Social Wand Keyboard: Keyboard extension that provides real-time AI suggestions while typing in other apps
• Multiple Tone Options: Various communication styles (Casual, Friendly, Professional, Empathetic, Witty, Romantic, etc.)
• Photo & Screenshot Analysis: AI analysis of images to understand conversation context
• Voice Input: Speech-to-text functionality for message input

3. Eligibility

You must be at least 13 years old to use this App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You will not use the App for any illegal or unauthorized purpose

If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have agreed to these Terms on your behalf.

4. User Accounts

To access certain features of the App, you may be required to create an account using Google Sign-In. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App to generate harmful, abusive, defamatory, harassing, threatening, or discriminatory content
• Use the App to impersonate others or misrepresent your identity
• Use the App to send spam, unsolicited messages, or engage in any form of harassment
• Use the App for any illegal activities or to violate any laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Use automated systems (bots, scrapers) to access the App without permission
• Share your account credentials with others
• Use the App to violate intellectual property rights of others
• Use the Keyboard Extension to monitor or record conversations without consent of all parties

6. AI-Generated Content

The App uses AI to generate suggestions, replies, and content. You understand and agree that:

• AI-generated content is provided "as is" and may not always be accurate, appropriate, or suitable for your specific situation
• You are solely responsible for reviewing, editing, and deciding whether to use any AI-generated content
• We do not guarantee that AI-generated content will be error-free, appropriate, or effective
• You should use your judgment and discretion when using AI-generated suggestions
• AI-generated content may not reflect our views or opinions
• You are responsible for ensuring that any content you send complies with applicable laws and platform terms of service

7. Permissions and Access

The App requires certain permissions to function properly:

• Camera: To take photos for conversation starters and context
• Photo Library: To select existing photos for analysis
• Microphone: For speech-to-text voice input
• MediaProjection (Screen Capture): For the Keyboard Extension to capture conversation context for AI suggestions
• Storage: To save app preferences and temporary files locally on your device
• Internet: To connect to our AI services and sync data

You can revoke these permissions at any time through your device settings, though this may limit or disable certain features.

8. Subscription and Payments

The App offers both free and premium subscription options:

• Free Tier: Limited number of AI generations per day
• Premium Subscriptions: Weekly, monthly, and yearly plans with unlimited generations
• Subscriptions are billed through Google Play Store or Apple App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can cancel your subscription at any time through your app store account settings
• Refunds are subject to the policies of Google Play Store or Apple App Store
• We reserve the right to change subscription prices with 30 days' notice
• Credits and subscription benefits are non-transferable

9. Intellectual Property

The App and its original content, features, and functionality are owned by Social Wand Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer or attempt to extract the source code
• Remove, alter, or obscure any proprietary notices
• Use our trademarks, logos, or brand features without permission

AI-generated content created using the App belongs to you, but you grant us a license to use anonymized, aggregated data for improving our services.

10. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your information.

Key privacy points:

• App preferences and settings are stored locally on your device
• Images and screenshots are processed by AI but not permanently stored on our servers
• We use third-party services for authentication, data storage, and AI processing
• We collect anonymous analytics to improve the App
• You can manage your data preferences through the App settings

11. Prohibited Content

You agree not to use the App to generate or request content that:

• Is illegal, harmful, or promotes illegal activities
• Is sexually explicit, pornographic, or obscene
• Promotes violence, hate speech, or discrimination
• Infringes on intellectual property rights
• Is defamatory, libelous, or invades privacy
• Is designed to deceive, scam, or defraud others
• Violates any platform's terms of service (WhatsApp, Instagram, dating apps, etc.)

We reserve the right to refuse service, suspend accounts, or terminate access for users who violate these prohibitions.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIAL WAND INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any AI-generated content or suggestions
• Any unauthorized access to or use of our servers or your data
• Any bugs, viruses, or other harmful code
• Any errors or omissions in the App's content
• Any actions taken based on AI-generated suggestions

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or quality of AI-generated content
• Warranties that defects will be corrected

We do not guarantee that AI-generated suggestions will be appropriate, effective, or suitable for your specific situation.

14. Indemnification

You agree to defend, indemnify, and hold harmless Social Wand Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you generate, send, or share using the App

15. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Request by law enforcement or government agencies
• Extended periods of inactivity
• Technical or security issues

Upon termination, your right to use the App will immediately cease. You may terminate your account at any time by deleting the App or contacting us.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

• Posting the new Terms on this page
• Updating the "Last updated" date
• Notifying you through the App (for significant changes)

Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Ghazipur, Uttar Pradesh, India.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Social Wand Inc. regarding the use of the App and supersede all prior agreements and understandings.
